Privacy Statement
WISCONLINE.ORG values and takes precautions to protect the personal information you provide us from loss, misuse, and unauthorized access, disclosure, alteration, and destruction. Within the WISCONLINE.ORG website online information systems, we ask you to provide contact information including your name, educational affiliation, mailing address, e-mail address, and phone number. We store your personal information in a secure database that we use to deliver the requested product to you.

Use of Your Personal Information
When you register, we ask if you would like to receive e-mail messages about our new products. We put your name on a mailing list for future product announcements only if you indicate that you want us to do so. If you contact us through our website and request information, we use the contact information you provide only for the stated purpose. Only a limited number of authorized employees have access to the information you provide. We will disclose your personal information if we are required to do so by law or legal process. Your personal information will be used only for the purposes stated above, will not be shared with third parties other than those described above, and will not be sold to third parties.

How We Use Cookie Technology
WISCONLINE.ORG products use cookie technology to initiate and maintain your session connections and to compile aggregated statistics about website usage. The cookie stores encrypted information verifying your access to the system. In no case is it used to access personal information, nor is the session information that is maintained in the cookie made available to other organizations.

Legal Notice All materials on the WISCONLINE.ORG website are copyrighted. Educational programs are provided FREE for use by educators and students by linking the materials (via copying and pasting the unique URL for each learning object) to educational web pages.

Introduction
WISCONLINE.ORG and/or its 16 technical college partners (together referred to as the WISCONLINE.ORG Consortium) operate this digital library and website and associated Web pages.

WISCONLINE.ORG offers you access to the Wisc-Online Digital Library in exchange for your agreement to accept and comply with these terms, conditions, and notices stated here and as may be modified by WISCONLINE.ORG from time to time. WISCONLINE.ORG refers to these terms, conditions, and notices, whether modified or unmodified, as the "Agreement" or as the "Terms of Use" or as the "Site Policies." WISCONLINE.ORG reserves the rights to modify in its sole discretion this Agreement without providing notification. You are responsible for regularly reviewing this Agreement. By visiting or using any part of the WISCONLINE.ORG website, you are agreeing to the terms of use, and you are agreeing that this is a binding contract between WISCONLINE.ORG and you. If you do not wish to be bound by these terms of use, please do not visit or use any part of the WISCONLINE.ORG website.

General Use and Limitations of General Use of the WISCONLINE.ORG Website Except where we specify otherwise, WISCONLINE.ORG offers you access to the WISCONLINE.ORG website solely for your personal and non-commercial uses. You may not obtain or attempt to obtain any materials or information through any means not intentionally made available or provided for through the WISCONLINE.ORG website.

If and when requested by WISCONLINE.ORG, you agree to provide true, accurate, and complete user information and to refrain from impersonating or falsely representing your affiliation with any person or entity. Except with the written permission of WISCONLINE.ORG, you agree that you will not access or attempt to access password protected, secure, or non-public areas of the WISCONLINE.ORG website. Unauthorized individuals attempting to access prohibited areas of the WISCONLINE.ORG website may be subject to prosecution.

You agree that you will not juxtapose the WISCONLINE.ORG name and mark and the link with your name or any other material(s) in a manner which might give rise to any erroneous conclusion that there is any affiliation or association between WISCONLINE.ORG, on the one hand, and you or any other person or entity, on the other hand. You agree that if WISCONLINE.ORG, in its sole and unfettered discretion, requests in writing that you remove any link or links to the WISCONLINE.ORG website, you will promptly do so. You agree that if you create any link to the WISCONLINE.ORG website that you will not employ any technology that results in the placement of content from the WISCONLINE.ORG website in a frame and/or a reduced pop-up window and/or any other display mechanism that changes the WISCONLINE.ORG website from how it would appear if a user typed in its URL to a typical browser line.

You agree that WISCONLINE.ORG may at its sole discretion and at any time terminate your access to and use of the WISCONLINE.ORG Digital Resource Library, or any part thereof, with or without notice.

Games
Wisc-Online registered users may purchase game templates on an annual basis to build customized learning activities. Credits cost $1 each, and one to three credits are required per template, depending on the template. To register as a Wisc-Online user, go to www.wisconline.org. Each registered user will have a website, hosted by Wisc-Online, to house his or her customized games for student use. In addition, registered users who buy a game template will be able to link and use the games as desired. Template purchasers are able to save and delete games within the established/purchased credit value. Template purchasers may submit their customized games to Wisc-Online for inclusion in the repository for free worldwide dissemination and/or made available to others for a $15 download of .swf files. The content of games will be juried prior to acceptance by Wisc-Online. If the game is accepted by Wisc-Online, authors of the games will receive equal credit to purchase another game template.

My Account Details - Games
A set dollar/credit limit may be established by registered users through credit card (Visa or MasterCard) or with purchase orders. Each registered user has a “My Account” account, which will provide account details on the number of purchased and earned credits, number of credits used, and number of credits remaining. Credits are good for one year from the date of purchase. Annual renewals of credits may be purchased to save existing games that were not submitted and/or accepted for inclusion in the Wisc-Online Resource Center. If a game is not on the Wisc-Online website, it will not be available after one year from the date of purchase unless it is renewed. Users may purchase downloads of their customized games for $15 per game.

No Warranty
There is no warranty, to the extent permitted by applicable law. Except when otherwise stated in writing by the copyright holders and/or other parties, WISCONLINE.ORG offers the WISCONLINE.ORG website "as-is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk of use of the WISCONLINE.ORG website is with you. Should the WISCONLINE.ORG website prove faulty, inaccurate, or otherwise unacceptable, you assume the cost of all necessary repair or correction.

WISCONLINE.ORG includes some health- or medical-related materials that may be considered sexually explicit, violent, graphic, or otherwise unsuitable for younger audiences. Viewer discretion is advised.

Purchasing Wisc-Online Products Please read this Agreement carefully before accessing the Service. By accessing the Service, you agree to be bound by the terms and conditions below. If you do not wish to be bound by these terms and conditions, you may not access or use the Service.

If you wish to make purchases of WISCONLINE.ORG products and services, you will be asked to supply certain information, including credit card or other payment mechanism information. You agree that all information you provide for purposes of making purchases will be accurate, complete, and current. WISCONLINE.ORG offers downloads, source codes, translations, training, and services. We set our own prices and may change prices or institute new prices at any time. You agree to pay all charges incurred by users of your account and credit card or other payment mechanism at the prices in effect when such charges are incurred. You also will be responsible for paying any applicable taxes and shipping/handling relating to purchases on the Service.

Downloads
You may purchase downloads of the learning objects. No changes to the downloaded learning object are allowed. You are bound to the uses as found under General Use and Limitations of General Use of the WISCONLINE.ORG Website

Source (.fla file) Codes
You may purchase .fla files of the learning objects. You may modify your copy or copies of the Program or any portion of it, thus forming a work based on the Program, and copy and distribute such modifications or work, provided that you also meet all of these conditions:(a) The WISCONLINE.ORG logo may be removed prior to purchasers receiving the source codes. (b) For each author's protection and WISCONLINE.ORG, we want to make certain that everyone understands that there is no warranty for this software. The purchaser receives it “as is.” If the software is modified by someone else and passed on, we want its recipients to know that what they have is not the original.

Failure to Comply With Terms and Conditions WISCONLINE.ORG may deny you access to all or part of the Service without notice if you engage in any conduct or activities that WISCONLINE.ORG in its sole discretion believes violates any of the terms and conditions in this Agreement. If WISCONLINE.ORG denies you access to the Service because of such a violation, you shall have no right (1) to access through WISCONLINE.ORG any materials stored on the Internet, (2) to obtain any credit(s) otherwise due to you, and such credit(s) will be forfeited, (3) to access third party services, merchandise, or information on the Internet through WISCONLINE.ORG, and WISCONLINE.ORG shall have no responsibility to notify any third-party providers of services, merchandise or information, nor any responsibility for any consequences resulting from lack of notification.

You agree to defend, indemnify, and hold WISCONLINE.ORG and its member organizations harmless from any and all liabilities, costs, and expenses, including reasonable attorneys' fees, related to any violation of this Agreement by you or authorized users of your account, or in connection with the use of the Service or the Internet or the placement or transmission of any message, information, software, or other materials on the Internet by you or authorized users of your account.

Miscellaneous In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties, and the remainder of the provisions shall remain in full force and effect. WISCONLINE.ORG’S failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between parties nor trade practice shall act to modify any provision of this Agreement. WISCONLINE.ORG may modify this Agreement from time to time by placing a notice of such modification on WISCONLINE.ORG, and your continued use of the Service following notice of such modification shall be deemed to be your acceptance of any such modification. If you do not agree to any modification of this Agreement, you must stop using the Service. This Agreement constitutes the entire agreement between you and WISCONLINE.ORG with respect to the Service.
